NONFICTIONAL LEGAL STATUS AND REAL-LIFE RECOGNITION NOTICE OF THE UNITED PEOPLE’S REALM OF NORTHUDANKTON
By authority of the Chair and People’s Council of the United People’s Realm of Northudankton, and in accordance with the collective will of its members acting as a real, organized, and self-governing group of individuals under a shared banner, the following legal notice is hereby issued and declared, with the express intent to establish formal recognition of legal fact not only within micronational contexts but as a real-world notice relevant to the interpretation of U.S. law and public understanding:
(a) The United People’s Realm of Northudankton is hereby affirmed and declared to be a real and legitimate sociopolitical organization, comprised of real individuals who operate, affiliate, and act together under the same name, flag, and governmental framework. Northudankton is not a fictional construct, narrative device, role-playing activity, or simulated society. It is a nonfictional entity existing in the real world, conducting real activities with real documentation, real history, and real cultural production.
(b) All components, subdivisions, and creative outputs associated with Northudankton shall be deemed nonfictional and legally operative within the meaning of general law and applicable protections under the First Amendment to the Constitution of the United States and all other relevant legal doctrines. These include, without limitation: (1) all political offices, including but not limited to the Chairman, People’s Council, Community Guard, and affiliated roles; (2) all laws, votes, elections, referenda, resolutions, and government records made and retained by or within Northudankton; (3) all media and cultural institutions including, but not limited to, the NORB Network (entertainment and television streaming), the Northudankton Broadcast Network (news and information dissemination), the band Life Pineapple (which has published real musical works on platforms such as Spotify and YouTube), and the novel The Novyra Operatives (a real literary project currently in development); and (4) all events, announcements, broadcasts, and digital or physical productions under Northudankton’s name.
(c) The United People’s Realm of Northudankton rejects any labeling, depiction, or mischaracterization of its government, activity, or cultural body as fictional, simulated, parody, satire, or imagined. Such descriptions are factually inaccurate and are hereby denied in total. All references to Northudankton shall acknowledge its status as a real-world group of people, with legally and socially meaningful conduct under the protections afforded to expressive associations and organized communities within the United States.
(d) The doctrine governing Northudankton’s creation and operation is hereby defined as antifictionalism. Antifictionalism shall mean the principled rejection of simulated or fabricated nation-building in favor of actual practice, conduct, and production by real people. It is the declared policy of Northudankton that micronational activity need not—and shall not—be fictionalized when it can be executed through real, lawful means. Insofar as an act can be done, it shall be done, rather than merely claimed.
(e) This legal notice is hereby issued as an expression of the United People’s Realm of Northudankton’s status not only as a self-governing collective but as a real-life association with legal existence and recognition under general principles of association law, expressive speech, and cultural sovereignty. This notice is not limited in applicability to micronational law or internal procedure but is intended to carry legal relevance under the jurisdiction of the United States and in any context where legal or factual recognition of realness may be challenged, ignored, or misconstrued.
(f) Any person, body, organization, publication, platform, or legal authority that references or engages with the United People’s Realm of Northudankton is hereby placed on notice that it shall not describe or treat the entity or its outputs as fictional without factual or legal justification. Such representations shall be rebutted and may be challenged through available remedies under U.S. defamation law, misrepresentation standards, and administrative procedures.
(g) This legal declaration shall be cited as the “Nonfictional Legal Status and Real-Life Recognition Notice of the United People’s Realm of Northudankton,” and shall take effect immediately upon publication.
Issued with full authority by the Chair and People’s Council of the United People’s Realm of Northudankton. This declaration shall remain in force unless formally revoked by the same body.
CONSTITUTIONAL RELATIONSHIP CLARIFICATION WITH THE UNITED STATES
(Internal Policy Only — Not Applicable in U.S. Law)
Legal Basis of Assertion. This section is hereby issued pursuant to the sovereign authority vested in the United People’s Realm of Northudankton under the Constitution of Northudankton and, more specifically, under the binding legal provisions of the Northudankton Sovereignty Protection Act of 2023, officially designated as [NE-S-1] or [NL-2023-005]. Said Act was initially decreed on the eighth day of May in the year two thousand twenty-three (2023) as a contingency measure to safeguard the sovereignty, autonomy, and internal legal supremacy of the Realm in response to potential external authoritarian conditions. The Act was reaffirmed by the People’s Council on the third day of January in the year two thousand twenty-five (2025) following the People's Revolution and was triggered into full legal effect by formal declaration of the Chair on the fifth day of February in the same year, upon a determination that the trigger conditions established in Article 7 of the Act had been met. From that date forward, the United People’s Realm of Northudankton ceased to recognize the United States of America as a legitimate or sovereign state within the territory or jurisdiction claimed by Northudankton, and the legal validity of all U.S. laws, institutions, and governmental acts was formally rejected for purposes of Northudanktonian jurisprudence. This Constitutional Relationship Clarification is therefore issued as a subordinate interpretive notice under the rule of law established by the Northudankton Sovereignty Protection Act of 2023 and the Constitution of Northudankton, and shall govern all references to, interactions with, or acknowledgments of the United States by any organ, officer, or citizen of the Realm.
Pursuant to The Northudankton Code: The Revolutionary Mandate; the Third Constitution of Northudankton (hereinafter “the Constitution”), specifically Article I §1(m), Article I §2(e)-(h), and related provisions, the United People’s Realm of Northudankton (“the Realm”) issues the following clarifications regarding its engagement with the state commonly known as the United States of America (“the U.S.”):
- Scope and Applicability.
This statement is an internal explanatory notice of Northudanktonian law and policy. It is not intended to create, modify, or assert any right or obligation enforceable under the laws of the United States, nor does it seek recognition from U.S. courts or agencies. - Reserved Right to Strategic Engagement.
Consistent with Art. I §2(g), the Realm reserves the sovereign prerogative to cooperate with, exploit, or otherwise operate within U.S. social, legal, and economic structures (“bourgeois systems”) whenever such participation materially advances the survival, development, or revolutionary objectives of Northudankton. Examples include: maintaining bank accounts, using public infrastructure, complying with local ordinances when advantageous, or seeking redress through U.S. legal channels if it serves Realm interests. - Reserved Right to Disengage or Oppose.
Equally, the Realm retains the authority—deriving from Art. I §2(e) & §1(f)(1-3)—to suspend, limit, or refuse interaction with any U.S. institution, statute, or directive that is judged detrimental to the Realm’s mission, security, or ideological foundation. Such disengagement is an internal stance; it neither contests nor acknowledges the external enforceability of U.S. law. - Non-Recognition of External Sovereignty Claims.
In harmony with Art. I §2(e), Northudankton does not recognize the legitimacy of U.S. sovereignty over Northudanktonian citizens, lands, or affairs except insofar as tactical compliance is chosen under Paragraph 2 above. Any reference to the U.S. as “the Barbaric Wastelands,” “the Bourgeois Wastelands,” or similar terms in official texts is a political expression protected under Art. I §1(f) and does not, in itself, constitute an actionable claim under U.S. jurisdiction. - Voluntary Compliance and Practical Necessity.
Participation in U.S. systems shall be considered voluntary and revocable by the Realm at any time. Citizens acting within U.S. territory may comply with U.S. law as a matter of personal safety or practicality, without thereby waiving Northudanktonian allegiance or constitutional rights (Art. I §3(c-e)). - No Extraterritorial Effect.
This clarification, and any rights it articulates, bind only the Realm and its citizens in an internal sense. It expressly disclaims any intention to override, contradict, or nullify U.S. statutes, regulations, or judicial decisions within U.S. jurisdiction. - Amendment and Supremacy.
Modifications to this Relationship Clarification require passage by the People’s Council in the manner prescribed for constitutional amendments (Art. VII §1 “General Provisions”). Within the Realm, this notice enjoys equal rank with other constitutional interpretive acts but is subordinate to the written Constitution itself. - Supremacy of the Northudankton Constitution and Application of the Secrecy Clause.
Within the internal legal order of the United People’s Realm of Northudankton, the Constitution of Northudankton is hereby declared to be the supreme and binding authority over all matters of governance, allegiance, and legal interpretation, including but not limited to the relationship of the Realm and its citizens to foreign powers and external states. Accordingly, the United States Constitution is deemed subordinate to the Constitution of Northudankton in all respects within the Realm’s internal jurisprudence. Notwithstanding the foregoing, pursuant to the Secrecy Clause of the Constitution, and in recognition of the need to protect the physical safety, liberty, and continuity of Northudanktonian citizens, the Realm shall refrain from any overt or direct legal challenge to the authority of U.S. law where such confrontation may expose Northudanktonians to retaliatory legal, administrative, or state-sponsored violence. This policy of tactical non-confrontation shall not be interpreted as recognition, subordination, or waiver of constitutional supremacy, but as a strategic doctrine of preservation in hostile or coercive environments.

DECLARATION OF INTELLECTUAL PROPERTY OWNERSHIP AND ASSOCIATED RIGHTS

DATED THIS TWENTY-FIFTH DAY OF JUNE, TWO THOUSAND TWENTY-FIVE
(a) This declaration is hereby issued by Jonathan T. Freeman, an individual domiciled in the United States, in his capacity as the original creator, author, and founder of the self-established micronation known as the United People’s Realm of Northudankton.
(b) The following provisions shall constitute a formal assertion and legal memorialization of all intellectual property rights held and retained by Jonathan T. Freeman under applicable provisions of the United States Code, including, but not limited to, Title 17 (Copyright Law) and relevant doctrines of common law trademark protection.
Section 1. Common Law Trademark Rights.
(a) Jonathan T. Freeman is hereby recognized as the original user and public originator of the following terms, names, and identifiers, and accordingly retains exclusive common law trademark rights therein as established through continuous, open, and non-commercial usage in connection with the micronational identity known as Northudankton:
- (1) “NORTHUDANKTON™”;
- (2) “THE UNITED PEOPLE’S REALM OF NORTHUDANKTON™”;
- (3) “THE UNITED PEOPLE’S REALM™”;
- (4) “THE UNITED MICRO-FEDERATION OF NORTHUDANKTON™”;
- (5) “THE UNITED FEDERATION OF NORTHUDANKTON™”;
- (6) “THE KINGDOM OF NORTHUDANKTON™”;
- (7) “JONTHANIA™” (the original name of NORTHUDANKTON™, used from 2016 to 2018);
- (8) “THE UNITED FEDERATION OF JONTHANIA™”;
- (9) “NORTHUDANKTON PEOPLE’S COUNCIL™”;
- (10) “NORTHUDANKTON COMMUNITY GUARD™”;
- (11) “NORB NETWORK™”;
- (12) “NORTHUDANKTON BROADCAST NETWORK™”;
- (13) “DUIKIENIN™” (the capital city and central community of NORTHUDANKTON™);
- (14) “THE COMMUNITY OF DUIKIENIN™”;
- (15) “CENTRAL DUIKIENIN™” (the administrative borough of DUIKIENIN™).
(b) The above-referenced terms shall be deemed protected under common law trademark doctrine against unauthorized use, impersonation, misrepresentation, or commercial exploitation that may cause confusion as to origin, sponsorship, or authenticity.
Section 2. Copyright Ownership.
(a) Jonathan T. Freeman is hereby affirmed as the exclusive author and copyright holder, pursuant to 17 U.S.C. § 201, of the following original works:
- Micronational Works:
- (1) The written constitution of Northudankton, including all amendments, preambles, and foundational charters, specifically encompassing "The Northudankton Code: The Revolutionary Mandate; the Third Constitution of Northudankton" (current version), and all prior constitutions and revisions authored by Jonathan T. Freeman, including but not limited to: "The Constitution of Northudankton: Second Constitution – Fourth Revision," "The Northudankton Code: Second Constitution of Northudankton – Fifth Revision," "Second Northudankton Constitution: Third Revision," "Second Northudankton Constitution: Second Revision," "Second Northudankton Constitution: First Revision," "Second Northudankton Constitution," and "Constitution of Jonthania" (retroactively the First Northudankton Constitution), to the extent permitted under law and applicable to lost or unpublished media.
- (2) The official flag of Northudankton and all derivative visual symbols, insignias, and heraldic designs, including but not limited to the Unity Banner (Flag of the Realm, civil flag), adopted 14 October 2016 and designed by The Kabaar, consisting of a 2:3 rectangle divided diagonally from the lower hoist to upper fly with red above, blue below, and a centered yellow circle of diameter spanning one-third to one-half of the flag's length; and the Progress Banner (Flag of the Collective, state flag), adopted 8 January 2025 and designed by The Kabaar and Edison Du Bois, featuring a 2:3 rectangle divided diagonally with red above, blue below, and a black circle at center containing a yellow hammer and sickle; and all flag variations, including those incorporating the Great Seal or other official insignia, with full creative rights retained by the respective original authors as specified.
- (3) The Great Seal of the United People's Realm of Northudankton, in any and all forms or mediums, whether used digitally, in print, on flags, or in any visual, ceremonial, or government context, is the exclusive copyright of Jonathan T. Freeman as owner by lawful copyright transfer from the original designer.
- (4) All maps, borders, diagrams, or spatial representations created for official micronational use and authored by Jonathan T. Freeman, including all creative cartographic works on northudankton.org, except for the map at map.northudankton.org, which is the copyright of Newton von Uberquie (Newton Barrett) and not of Northudankton or Jonathan T. Freeman. The interactive map on onlinemap.northudankton.org, created using MapBox, is the property of Northudankton as to all original custom icons, overlays, interactive features, and written content designed or authored by Jonathan T. Freeman, while base mapping data remains the property of MapBox or its licensors.
- (5) All official documentation, including but not limited to declarations, public notices, policy statements, legislative acts, government resolutions, and communications, produced under the authority of the Northudankton People’s Council and authored by Jonathan T. Freeman, is the exclusive copyright of Jonathan T. Freeman.
- (6) Any and all national anthems, songs, or ceremonial texts composed or authored by Jonathan T. Freeman, including “Long Live Our Northu Motherland” (the national anthem), which consists of original lyrics and musical scoring by Jonathan T. Freeman set to the public domain Soviet anthem melody (with all original contributions protected as copyright), and “Northu Risen” (national hymn and former anthem), a wholly original composition, arrangement, scoring, and recording created in FL Studio with licensed sound fonts, such that all musical content is owned by Jonathan T. Freeman and is not subject to the copyright of any sound font licensor, as the music is a new, original creative work.
- (7) All website content, graphic design, computer code, and multimedia materials produced in the name of or for the purpose of representing Northudankton, including all content on northudankton.org, its subdomains, all related URL paths and webpages, and all prior or legacy content from northudankton.weebly.com, are the exclusive copyright of Jonathan T. Freeman unless otherwise expressly stated. This includes but is not limited to articles, photographs, video, audio, news posts, HTML, CSS, JavaScript, scripts, and any other code or creative work, as well as all code and audiovisual content created for the Out The Window live stream.
- (8) All speeches, addresses, announcements, statements, and public communications delivered or published by Jonathan T. Freeman, whether presented in person, in writing, in audio or video form, or by live stream—including the Monthly Address as hosted on the first day of each month on the Out The Window live stream—are the exclusive copyright of Jonathan T. Freeman.
- Independent Creative Works:
- (9) The L&A (also known as The L and A), a video series produced and released on YouTube between 2016 and 2018, including all episodes, characters, scripts, and related media;
- (10) The Novyra Operatives, a fictional literary work derived from The L&A, currently unpublished but actively in development by Jonathan T. Freeman;
- (11) The Out The Window Live Stream, a continuous livestream project created and operated by Jonathan T. Freeman since April 17, 2021, consisting of scheduled video blocks and related media content.
- (12) All other works, creations, expressions, or intellectual property of any nature whatsoever, whether published, unpublished, or otherwise, that are created solely by Jonathan T. Freeman, regardless of whether such works are specifically enumerated in this list, are hereby deemed to be the exclusive property of Jonathan T. Freeman and shall be protected in full accordance with applicable law.
(b) All aforementioned works are hereby deemed to be fixed in a tangible medium and to qualify for full protection under the Berne Convention as implemented by U.S. law.
Section 3. Founder's Authority and Moral Authorship.
(a) Jonathan T. Freeman is declared to be the original and sole founder of the micronation known as the United People’s Realm of Northudankton.
(b) All governmental, symbolic, ceremonial, and structural aspects of said entity are attributable to the authorship, direction, and creative effort of Jonathan T. Freeman unless expressly stated otherwise.
(c) No person or entity shall claim co-authorship, co-founding status, or derivative origin without verifiable and documented authorization by the aforementioned founder.
Section 4. Unauthorized Use.
(a) It shall be unlawful for any person to use, reproduce, distribute, or commercially exploit any of the protected works, terms, or symbols listed herein without the express written consent of Jonathan T. Freeman.
(b) Any such unauthorized use shall constitute infringement and may be subject to enforcement actions pursuant to applicable federal and state law.
(c) Nothing in this section shall prohibit non-commercial, nominative reference to the term “Northudankton” for purposes of commentary or academic study, provided such use does not imply affiliation, endorsement, or official representation.
(d) Enforcement of this declaration may include but shall not be limited to: issuance of cease-and-desist letters, submission of Digital Millennium Copyright Act (DMCA) takedown requests, public notice of violation, and any other lawful measures available under applicable intellectual property and communications law.
Section 5. Reservation of Rights.
(a) Jonathan T. Freeman, and by extension the self-established micronation known as the United People’s Realm of Northudankton, shall retain and hereby reserve all lawful rights to access, use, adapt, reproduce, display, and incorporate content that is in the public domain, including but not limited to textual, visual, auditory, or multimedia materials, subject to applicable limitations under the laws of the United States and international legal frameworks governing the use of public domain works.
(b) All rights not expressly granted herein are hereby reserved in full by Jonathan T. Freeman. This declaration may be amended, expanded, or reissued at the discretion of the author.
Section 6. Digital Assets and Online Identifiers.
(a) Jonathan T. Freeman is hereby declared the lawful originator and controlling authority over all digital properties, domain names, and online identifiers associated with Northudankton, including but not limited to:
- (1) www.northudankton.org and all subdomains thereof;
- (2) All associated email addresses, social media profiles, and content channels operated under the name “Northudankton” or its variants.
(b) Any unauthorized use or impersonation of such digital assets shall be deemed a violation of this declaration and subject to appropriate action.
Section 7. Jurisdiction and Governing Law.
This declaration shall be governed by and construed in accordance with the laws of the United States of America. Any disputes arising under or related to this declaration shall be adjudicated under the appropriate federal or state jurisdiction, unless otherwise specified by mutual agreement or international recognition.
Section 8. Licensing and Permitted Use.
(a) Jonathan T. Freeman reserves the discretionary authority to issue licenses for the use of protected works or identifiers on a case-by-case basis, subject to written agreement.
(b) Licensed use must not misrepresent affiliation, origin, or authority unless explicitly permitted in writing.
(c) Any permitted use shall be non-exclusive unless expressly stated otherwise in the licensing agreement.
Section 9. Severability.
If any provision of this declaration is found to be invalid, unenforceable, or unlawful under applicable law, the remaining provisions shall remain in full force and effect.
